Solihull shop shut until November after illegal tobacco and vape sales

A Solihull shop has been ordered to close until November after being caught selling illegal tobacco and vapes, including a vape to a child.

Boss Mart 2 on Warwick Road, Olton, has been shut following a closure order granted to Solihull Council at Birmingham Magistrates' Court.

The order was granted on Wednesday, August 26, and prevents people from entering or remaining inside the premises until November 26, 2026.

The council said the action followed continued illegal activity dating back to September 2025.

It said its Regulatory Services Team had seized illegal tobacco, vapes and unsafe toys during investigations into the shop.

Officers also carried out test purchases, during which the shop allegedly sold a vape to a child and illegal tobacco to undercover Trading Standards officers.

The council said the business had previously been subject to a closure order in 2024.

Shop owner ordered to pay £1,400

The business and its owner, Mir Afzal, were also ordered to pay a total of £1,400 in costs.

The latest closure order was made under the Anti-Social Behaviour, Crime and Policing Act 2014.

The council said the action was taken following continued illegal activity despite previous enforcement.

Councillor Andy Mackiewicz, Cabinet Member for Climate Change and Planning, said the council would continue to take action against businesses selling illegal products.

He said: "This closure order demonstrates that we will take action against businesses that repeatedly break the law and put residents at risk."

The council said its Trading Standards team would continue to investigate businesses suspected of selling illegal tobacco and vapes.

Closed until November

The closure means the premises at 53 Warwick Road cannot be accessed by members of the public until November 26.

The only exceptions are those specifically named on the order, including the landlord, the landlord's contractors and emergency services.

The case is the latest enforcement action against a Solihull business accused of selling illegal products.

For residents in Olton, the shop will now remain closed for the next three months.
